1Validity

1.1 These terms and conditions apply in addition to the privacy policy for the purchase of used electronics. All services are subject to these terms and conditions. Other arrangements only come into effect with the express agreement with management.

1.2 Sobby advises the seller to print and read the general terms and conditions. Because the terms and conditions can be adjusted over time, we recommend that you read and accept the terms and conditions that apply at that time for each sale via the website.

2 About Sobby.

2.1 Sobby (hereinafter referred to as "Sobby"). The website www.sobby.eu is managed by Sobby, Zwaluwstraat 7 4561kl Hulst

3 About seller. Seller guarantees:

3.1 to be the rightful owner of the offered devices, or has permission from the owner to sell offered devices to Sobby.

3.2 be a resident of the Netherlands or Belgium.

3.3 be at least 18 years old.

4 Contract

4.1 The seller makes an agreement with Sobby for the sale of the device by completing the online form on the Sobby website and sending it digitally. The distance selling Regulations Act and the 14-day withdrawal right for the consumer are therefore not applicable. However, up to the moment of payment of the agreed amount to the seller, the seller always has the right to return his product free of charge without giving a reason.

4.2 The Seller cannot transfer, reject or otherwise dispose of the Agreement without written permission from Sobby.

4.3 Sobby has the right to terminate the contract if it turns out that the product offered to Sobby has been obtained unlawfully by the seller. Sobby will always contact the seller first and allow 2 weeks to tell Sobby. In the absence of a response, Sobby will report the product to the police, the digital buyers' register and, where possible, send it to the rightful owner. Sobby will never transfer information about the seller to a third party unless sobby is obliged to disclose this information by government agencies.

5 Sales, shipping, returns and payment

5.1 The price offered for the devices is determined as part of the online process. By submitting the online form, the seller makes an offer to Sobby to purchase the device. All prices on the website include VAT or fall under the margin scheme for purchasing from private individuals. The calculated price is valid for fourteen (14) calendar days after completion of the online sale. The calculated amount is paid if the calculator is entered correctly. Sobby reserves the right to refuse the device and to return it. With price adjustments, Sobby will always first consult with the seller via email in which the seller has the option to agree to the new price proposal or have the device returned to the seller. The seller has 30 days to respond by telephone or e-mail. If the seller does not respond during this period, Sobby will transfer the adjusted amount to the seller. For products with no value, Sobby will recycle the device. The seller agrees that when sending goods with defects the goods are in some cases screwed open by our technical department to verify the indicated defects.

5.2 After entering your details on the website and sending the online form, you will receive a confirmation e-mail from Sobby. You will also be assigned a sales number.

5.3 You will always be paid within 1 working day after receiving your product from Sobby. If this does not happen, you will be paid 15 extra. This only applies if, according to Sobby, the calculator has been filled in completely truthfully, your personal details are correct, the instructions in our confirmation e-mail have been correctly executed and the item sold is working and charged.

5.4 After you have entered the devices online and completed the sale, you must send the devices by registered mail via PostNL. Your shipment is then insured up to an amount of 500 euros. The seller provides a suitable, stable and tear-resistant envelope or package.

5.5 Seller make sure that the devices are sent within 30 calendar days after receiving the confirmation email, the transaction of the device in question will be canceled at Sobby without sending.

5.6 The ownership of the devices transfers to Sobby at the time that the agreed sale amount is transferred to the seller. Sobby is not responsible for devices that are lost during transport to Sobby. The risk of loss or other damage during transportation is borne by the seller until delivery by the carrier to Sobby. For this reason, Sobby obliges its customers to send the objects by registered and insured up to 500.00.

5.7 Sobby advises seller to turn to PostNL for the conditions of shipment. These can be viewed on www.postnl.nl and can be made available by Sobby on request.

5.8 If, in your opinion, the maximum amount of PostNL's liability does not sufficiently cover the value of your shipment, you can take out (supplementary) insurance. These costs are borne entirely by the seller. For more information about sending postal items, we recommend that you contact PostNL.

5.9 As soon as the shipment arrives at Sobby and the conformity with the online data and the current status of the device has been verified, the seller will receive an email from Sobby with the receipt and payment confirmation.

5.10 Payment takes place within 1 working day from the moment we receive the devices. Payment will be made via a transfer to the account number indicated at the sale. Responsibility for delays due to incorrect information will not be borne by Sobby.

5.11 As long as Sobby has not yet paid your item, the seller can choose to have the item returned at any time. There are no costs involved, unless the object is provided with a pin code or iCloud lock. In these cases, the seller must pay for the return shipment itself. The costs for return shipment to the seller is € 7.00

6 The devices

6.1 The prices offered are only applicable to fully working devices and correctly filled in calculators / auction pages. Unless otherwise agreed via email.

7 Collection, processing and use of your personal information

7.1 Sobby collects personal data (such as first name, last name, address, city, bank details, telephone number and e-mail address) exclusively for the implementation of the trade-ins and only for the context and scale required for this. The data will be treated in accordance with the legal provisions of the General Data Protection Regulation, the Teleservices Act, the Telecommunications Act and other legal requirements for the documentation of business transactions and sales agreements.

7.2 Under the General Data Protection Regulation, the seller has the right to free information about the stored data, as well as the right to correct, block or delete data. To make use of these rights, in particular the obtaining of information, the seller can write to info@sobby.eu

7.3 Sobby will not share information with third parties, nor will it use the data for purposes other than the sale of the offered object.

7.4 Information that Sobby stores from the seller is mainly used and stored for the settlement of the purchase contracts (including communication, delivery and payment). Third, the information sent is used without permission to perform technical, logistical or other functions that facilitate Sobby's compliance with contractual obligations.

8 final provisions

8.1 Only Dutch law applies to all legal relationships to which the User is a party.

8.2 All disputes, with the exception of those that fall within the competence of the sub-district court, will be settled exclusively by the court in Amsterdam.
